Requirements for RecordationSTAMPED SELF-ADDRESSED ENVELOPE OF SUFFICIENT SIZE TO ACCOMMODATE DOCUMENTS MUST BE INCLUDED WITH EVERY RECORDING OR REQUEST.The following is a list of requirements that will help reduce the number of documents returned. These items are required by all Recorders who are members of the Pennsylvania Recorder of Deeds Association.

1. Acknowledgment date cannot predate document date.

2. Acknowledgment must include the following: County, State, date, person or corporate officer’s  names and titles of persons appearing, notary signature, seal and expiration date. If any item is missing, the acknowledgment is defective.

3. Deeds and mortgages should indicate the property’s  municipality, county, and state.

4. Numerical amount must match written amount on deeds and mortgages.

5. Book and page numbers of mortgages must appear on all documents that refer back to this document.

6. Transfer taxes or statement of value must accompany all transfers unless exemption is clearly stated in the deed (family transfers). The Department of Revenue requires statement of value form to be fully completed.

7. Multiple documents constituting one transaction must clearly indicate on each document the order of recording; any re-recording expenses from improper order of recording will be paid by party submitting document.

8. Re-recording of document must be re-acknowledged.

9. Deed with transfer tax in more than one municipality must stipulate division of transfer taxes.

10. Deeds and mortgages and assignments must have certified grantee/mortgagee address; certifications should be signed.

11. All checks must include the account holders address.

In addition to the above items Montgomery County requires:

A PIN (parcel identifier number) number must be on all documents. This is a 12 digit number in our county.

All documents must be registered by the Montgomery County Board of Assessments prior to being recorded.  The Montgomery County Board of Assessments is located directly across the hall from the Montgomery County Recorder of Deeds office on the third floor of One Montgomery Plaza.

Pre-Registration of Deeds was rescinded as of December 9, 2008; however, some Boroughs and Townships still require registration of deeds afterrecording. It is the submitter’s responsibility to take the deed to the municipality to be registered after it is returned to them from the Recorder of Deeds Office.

About the DepartmentThe mission of the Montgomery County Recorder of Deeds office is to maintain the integrity of all land records and other documents entrusted to the department as well as the collection and monthly distribution of County / State fees and Real Estate Transfer Taxes for the State, Townships, Boroughs and School Districts; while efficiently serving the public with complete accountability and responsibility.

All legal instruments in the County including deeds, real estate transfers and agreements, mortgages and assignments thereof are filed with the Recorder of Deeds. In addition, state highway plans, charters, powers of attorney, sub­division plans and commissions for elected officials and notary publics throughout the County are also filed in this office.  Real estate transfer taxes are collected for the state, townships, boroughs and school districts and distributed monthly.

 
REAL ESTATE TAX SALES
 
In accordance with the Tax Sale law, the Tax Claim Bureau is able to sell parcels in one of four ways:
 

1)         Upset Sale
2)         Private Sale
3)         Judicial Sale
4)         Repository Sale
 
 
 
 
(1)
The Upset Sale is scheduled each September and includes those parcels whose taxes, from two years earlier, remain unpaid or other specified conditions exist.  Properties scheduled to be presented for Upset Sale are advertised in two newspapers and the Montgomery Bar Association journal within two months of the sale.  Purchasers of property at the Upset Sale assume responsibility for all liens on the property.
 
(2)
A Private Sale can occur after a property has been exposed but not sold at an Upset Sale.  An interested buyer submits a written bid to the Tax Claim Bureau.  The Bureau then decides whether or not to accept the bid.  If accepted, the bid is advertised in a newspaper and the Montgomery Bar Association journal.  Any one objecting to the sale must petition the court within 45 days to disapprove  the sale.  As in the Upset Sale, purchasers of property via the Private Sale assume responsibility for all liens on the property.
 
(3)
A Judicial Sale is held at least once each year and can include only  those properties that have been exposed but not sold at an Upset Sale.  After advertisement, notice to owners and lienholders, etc., the parcels are presented free and clear of all liens.
 
(4)
Properties that are exposed but not sold at a Judicial Sale are placed in a Repository for unsold properties.  Any bid on a Repository Property must be approved by all taxing districts where the property is located (i.e. township, borough, county, school).
